Water management technical documentation

The water management authorization represents the legal and technical act that conditions the operation or exploitation of all new objectives, as well as those built on the waters or related to the waters.

The procedure for issuing the water management approval is conducted by the National Administration “Romanian Waters” or by the subordinate units, as defined in the Water Law no. 107/1996, with subsequent amendments and additions. The procedure for issuing the water management permit may include the assessment over the impact of the works on the water bodies, based on the impact on water bodies assessment study.

The water management approval is issued after carrying out an analysis regarding the need to assess the impact on water bodies or, as the case may be, the analysis of the impact assessment study on water bodies, by a commission established at the level of the competent water management authority. The composition of the commission is approved by decision of the head of the competent authority for water management.

The impact on water bodies assessment study is a technical documentation elaborated by certified persons, which identifies the causes and negative effects on water bodies of some projects with a significant impact within the impact assessment process; This study is a process designed to identify, describe and establish, on a case-by-case basis and in accordance with applicable legislation, the direct and indirect, synergistic, cumulative, primary and secondary effects of a project on human health and the environment.

The ecological flow is the necessary flow for the protection of aquatic ecosystems, both in terms of quantity and dynamics, in order to achieve the environmental objectives for surface water bodies. It must be assured downstream of all transversal water works or water abstractions located on the watercourses.
